This privacy policy explains how SWICS Ltd process and store your personal information and data. As our company and servers are located in EU, our obligation is to adhere to the General Data Protection Regulation (GDPR) - Regulation (EU) 2016/679 of the European Parliament and of the Council - that taken into effect on May 25th, 2018. The primary purpose of this document is to inform our clients in clear and understandable language how we care for their data and privacy. The present privacy policy applies to all services and websites which SWICS Ltd owns, manages and offers to its clients.
For the purpose of this privacy policy, "personal information" means "personal data" and both of them will be used interchangeably.
When you register with us to use FormWarePro Service, you will need to provide:
1) an email address
2) a password for your account
Additionally, we collect your IP address. You can also provide to us voluntarily more details about you in "My Account/Profile & General Information" page,
but these details are not required for using the Service and include the following data: your names, nickname, city, state/province, county, company name,
industry, website. You will need to provide a nickname on that page only if wish to share any of your forms as a template for use of other users via
the Templates gallery. In other hand, if you use any of the external services available on the "Login" page to sign in, we will collect your public API key
and email address for the external account that you use to sign up with the FormWarePro Service. Further, you will be able to provide a password to use with
that email address in order to have FormWarePro login credentials, and additionally to remove the external login for more secure account if you wish. For
using the Service through a paid plan we collect following information: your first and last name, address, city, state/province, country, company/organization name,
VAT number (for EU clients), phone number, fax number, email address (these are different from the details for the profile) and credit card information.
Some of these data are not required and depending on the chosen license type, the amount of data we collect differs.
We collect also following system data ("System data"): browser model and version, operating system version, device model and manifacturer, device type, as well as timestamp. If you access the website from an external source for example another website, email or link we collect web address of the source from that you navigate to us. In addition to data submitted through the forms by end-users, we collect the IP address and the System data of the users who submit the forms.
The FormWarePro service is hosted on Amazon Web Services (AWS) and our servers are based in datacenters in Europe, so your personal information will be stored and processed by SWICS Ltd in Europe. We store the information we collect on our database servers and other storage volumes, as well as on some AWS services.
SWICS Ltd use the information provided on the "Profile & General Information" page in order to pre-populate some fields on the "Checkout" page if you decide to subscribe
for a paid plan. This will only happen for first-time subscription. We also use that information to know our clients and to be able for us to offer specific
solutions upon requests or sugestions. Information provided on the "Checkout" page is used for your invoices and subscriptions, as well as for security purposes
(for example frauds prevention). You will be able to provide different contact details (name and email address) for the recipient of the invoices if you wish,
through the "Subscription" page once you purchase your first subscription. We use your IP address along with the System data for following purposes: system
administration and maintenance; prevention of spam, phishing and frauds; tracking your activite on the web site including when you purchase a subscription,
upgrade or downgrade, modify license type, update credit card and billing information and other activity in regard to your subscription.
We store the IP address and system data from the end-users submissions anonymously and use them for statistical and debugging reasons, and for improving the service.
By agreeing to this privacy policy or by clicking "I agree" or other similar means, you expressly consent to us to use your personal and System information for the
purposes described in this privacy policy. If you wish to opt out from the foregoing consent, you must terminate your account or not submit a form upon request.
SWICS Ltd do not store, process or transmit your credit card information (credit card number, expiration date and CVV) on our servers. Instead, we rely on Braintree
(a validated Level 1 PCI DSS Compliant Service Provider) to handle this for us.
We do not share with, nor sell your form data ("Form data" means the data collected via your forms) to any third parties, unless we have your express consent or upon your request. This is true for all data submitted via your forms, as well as all your uploaded files. However, we share your billing information when you purchase a subscription. We share that information with our third-party Payment Service Provider. SWICS Ltd has a contract with this service provider to keep your information safe and secure and to use it only for the purpose of providing their service. We share your personal data with our third-party Accounting Service, specifically for your invoices and/or other tax, administrative and regulatory documents. We also share your email address with email service providers when we send to you submission reports and/or other notifications. We may share your IP address and other System data with our hosting provider (Amazon Web Services) to track traffic and activity to/from the site for security purpose. By using our service and agreeing to this privacy policy, and expressly agreeing when you purchase subscription, upgrade or downgrade your account, update payment details or license information, you consent to this disclosure. SWICS Ltd may disclose your information upon a request by authorities, or when we believes that disclosure is necessary to protect our rights, protect you or your data, to protect other clients and their data, to comply with a judicial proceeding, court order, subpoena, or other legal documents or process served on or required from us. We may disclose aggregated and/or anonymized information to third parties with purpose to improve or promote the FormWarePro service.
Cookies are small text files (encrypted or not) that are placed on your desktop or mobile device by websites that you visit. They can be used for various purposes
for example: for authentication, for website efficiency, to help and improve website functionality, etc.
SWICS Ltd use cookies for your authentication. We also may use cookies for particular functions of the Service, which use them to work properly, if other web
technologies are not enabled on your browser.
In addition to the above, SWICS Ltd has implemented certain Google Analytics features on our website. To provide website visitors the ability to prevent their
data from being used by Google Analytics, Google has developed a Google Analytics opt-out browser add-on. If you do not wish to participate in Google Analytics, you may download and install the add-on for
your web browser.
To keep your personal data secure, we use 256-bit Advanced Encryption Standard (AES-256) when store these data in our database. Moreover, we use encryption for all our storage volumes ensuring the security of both data-at-rest and data-in-transit. The FormWarePro service can be accessed only via HTTPS and we apply an explicit restriction this access to be performed only via TLS 1.2 or higher cryptographic protocols as is imposed by the PCI Security Standards Council. Furthermore, we adhere to the PCI DSS and best industry practices in order to protect your data and privacy. However, where you have chosen a password which enables you to access the Service or particular feature, you are sole responsible for keeping this password confidential. We will never ask you to share any password with us. We are working continuously on improving the Service security. This is top priority task for us. Your forms and data you collect with them are your ownership and responcibility. Your forms are private until you publish any of them via a direct link or other
available options. Furthermore, even when a form has been already published, you will be able to disable access to it if you want to do so. SWICS Ltd does not
sell or make available your forms to other clients or third parties. The collected data via your forms are only private. We may internally use your information,
including certain form data, for limited purposes for example: to detect and troubleshoot service issues; to improve and develop new features; to monitor performance
and/or abusive activity; to maintainance the Service operational; for statisticals analysis; to improve the security of the Service.
It is your responsibility for obtaining consent from your end-users, managing and maintaining any personal data you collect via your forms.
The forms are created, managed, maintained and published by their owners. SWICS Ltd hosts those forms on our servers and stores submitted with them data. You will need to contact the forms owner for any inqueries about their forms, because we do not take any responsibility for content of these forms and/or data that are collected with them. You should contact SWICS Ltd only in case you want to report for spam, phishing, frauds or any other illegal activity or violation of the Terms of Service in regard to the forms. SWICS Ltd will hold your personal data for a term no longer than is necessary to provide the service to you in accordance with the Terms. However, we will retain personal data for the purposes of the tax administration and regulatory requirements for the permitted and/or required term according to the Bulgarian legislation. We may retain for longer some of your personal data along with other System information for security reasons.
The FormWarePro service provides a user interface and implemented software logic for deletion of your account and personal data if you decide to delete your FormWarePro account. This is available on page My Account / Profile under the "Delete Your Account And Information" section heading. You will need to click on the "Delete My Account" button that will take you to a new page where you need to follow the instruction in order to delete your account. If you have subscribed for a paid plan and you have an active subscription you will need firstly to cancel your subscription in order to be able to delete your account. Additionally, you can always request from us to delete your account if you have difficulties or for any reason. Just send us an email requesting deletion of your account by using the provided contact information or user interface for sending messages on page Contact Us and we will get it done for you. If you have an active subscription we can cancel for you your subscription as well. After subscription cancelation you can consume the rest of the paid period after that we will delete your account (or you can do it yourself as well). Alternatively we can delete your account immediately, but in this case you will loss the remaining time from your paid servise use unless you are elligable for requesting a refund and you have requested it.
SWICS Ltd reserve the right to modify this privacy policy at any time and for any reason. If we do that, we will notify you in advance by posting the changes on the website and we may send to you an additional email notification in our sole discretion.
